That may be true under Chapter 7, but more often than not I find people who think they cannot file under Chapter 7 actually can do so. Some people who could file under a Chapter 7 choose to file a Chapter 13 instead because only in that chapter can they strip off their second mortgage. Don't assume you don't qualify for bankruptcy. We also make sure that if you need a second mortgage or judicial lien stripped that you are fully advised of that option. Also, filing bankruptcy often necessitate that you make a series of decision in deciding how to prepare for the filing, and these decisions require good counseling to make sure you make the best decision for you. This is the process LeverLaw is particularly adept at, because we know that it is your life and the decisions you make for you and your family are highly personal. However, you will make those decisions with full knowledge of every consideration I believe is relevant and in your best interest.

We only file bankruptcies to make people's lives better. Sometimes a bankruptcy is not appropriate, especially if your main concern should be survival, and not necessarily dealing with your creditors if you're down to your last dollar and it is a choice between eating and bankruptcy, then you should wait to file a bankruptcy later, if and when you can afford it.
